What are the penalties for a Second DUI conviction in Tennessee?

The mandatory minimum jail time for a 2nd offense DUI is:

  • Mandatory minimum of 45 days in jail, up to a maximum of 11 months and 29 days
  • Your license will be revoked for 2 years with immediate eligibility for a restricted license upon application.  The restrict license requires the interlock device for any conviction of DUI when the person blows over a .08 BAC.  The “old version” of restrict license (i.e. back and forth to work, school, church, probation meetings, treatment programs, etc.) is still available in very few instances for convictions of Implied Consent.
  • You will be ordered by the court to go to DUI School
  • There is a $600 minimum fine and a $3,500 maximum fine
